Data Privacy Policy

Introduction

Technoserve Co., Inc. (hereinafter referred to as “TCCI” for brevity) or formerly Technoserve Construction Co., Inc., is a recruitment agency duly licensed by the Department of Migrant Workers (DMW). TCCI is the recruitment agent of JGC Construction International PTE. LTD. Incorporated of Singapore and is at present supplying manpower exclusively to projects undertaken by JGC Corporation in Yokohama, Japan.

TCCI is committed to protect the security and privacy of your personal data. In doing so, this Data Privacy Policy is developed in order to adopt and observe appropriate standards for data protection in compliance with Republic Act No. 10173, also known as the Data Privacy Act of 2012 and its implementing rules and regulations.

By accessing https://tcci-jgc.ph/ and/or submitting your personal data to us, you consent to the collection, use and processing of your Personal Data and accept and agree to be bound by the terms stated in this policy. Rest assured that your Personal Data will not be used and disclosed in a manner not stated in our privacy policy statement.

Purpose of Data Collection

TCCI uses your Personal Data, among others, for the following purposes:

  • recruitment, processing, and related services;

  • matching candidate qualifications versus job opportunities available;

  • endorsing experience, qualifications, and credentials to our client;

  • verification of credentials and other personal data;

  • monitoring of work performance;

  • administration of salary and benefits;

  • communication of relevant information on job opportunities and response to inquiries.

Manner of Data Collection

TCCI collects Personal Data directly from you when you:

  • transact with TCCI staff in person, by telephone, letter, e-mail, fax or via our website or TCCI online job portal advertisement/s;
  • submit your CV or Résumé and/or accomplish our Application Form;
  • submit any other information in connection with your application.

Personal Data may also be obtained from third parties that TCCI will contact for verification purposes, such as in the following instances:

  • from the references you have provided;
  • from academic institutions and/or professional associations or licensing bodies of the educational and professional qualifications you stated in your CV and/or application letter;
  • from former employers and co-workers;
  • from feedback in the workplace you were involved in, to include any administrative proceedings; or
  • from any investigation efforts, professional license disciplinary matter, or criminal, civil or other legal proceedings in which you are or were involved.

Disclosure of Personal Data

In general terms, TCCI will disclose or share the Personal Data you have provided us to members of the JGC Group of Companies and its affiliates. This could mean that Personal Data may be transferred outside the Philippines. Your Personal Data may be stored in servers located either in the Philippines or overseas.

Your Personal Data may have to be shared to third parties who have proper interest and only with your consent, unless permitted or required by law.

Under all these circumstances, appropriate steps shall be undertaken to ensure that your Personal Data will be used for the stated purpose and in accordance with the proper instructions from TCCI, and to comply with the Data Privacy Act and its Implementing Rules and Regulations.

Personal Data Security and Retention

TCCI adopts appropriate and adequate organizational, physical, and technical measures to safeguard your Personal Data from disclosure, alteration, unauthorized access, destruction, fraudulent misuse and/or any other unlawful processing.

To ensure security, integrity and confidentiality, TCCI strictly enforce its Data Privacy Policy by storing your Personal Data in secured computer server/facilities and paper-based files. Other data protection measures in place are:

  • use of computer passwords limiting the access to shared network drives and folders;
  • installation and regular updating of reliable anti-hacking/anti-spyware software to all Office PCs to safeguard stored data from malicious internet activities;
  • use of multi-factor authentication (MFA);
  • designation of authority to qualified personnel to access hard and soft copies containing personal data;
  • installation of locks and security systems in the entire office premises;
  • regular conduct of audit and testing of data security protocols;
  • established notification procedure to you and the National Privacy Commission in the event that sensitive personal data that may, under the circumstances, enable identity fraud are believed to have been acquired by unauthorized person;
  • secured access to update information.

Personal Data is retained by TCCI for as long as necessary to be used in a lawful, fair, and relevant way for the purposes stated herein. If such is no longer required or if you ask to be removed from TCCI’s systems, TCCI shall dispose or delete your Personal Data in a secure manner that would prevent further processing, unauthorized access, or disclosure to any other party or the public in general.

Rights of the Data Subject

As a data subject, you have the following rights in accordance with the Data Privacy Act, its IRR, and other relevant issuances:

  • Right to be informed – You have the right to be informed whether your personal data will be, are being, or have been processed, including the existence of automated decision-making and profiling.
  • Right to access – You have the right to request access to any of your personal data, subject to certain restrictions.
  • Right to object – You have the right to object to the processing of your personal data where such processing is based on consent or legitimate interest.
  • Right to erasure or blocking – You have the right to request for the suspension, withdrawal, blocking, removal, or destruction of your personal data from TCCI’s filing system, in both live and backup systems.
  • Right to damages – You have the right to be indemnified for any damages sustained due to inaccurate, incomplete, outdated, false, unlawfully obtained, or unauthorized use of your personal data, taking into account any violation of your right and freedoms as data subject.
  • Right to file a complaint – You have a right to file a complaint if you feel that your data privacy rights were violated.
  • Right to rectify – You have the right to dispute any inaccuracy or error in your personal data and have TCCI correct the same within a reasonable period of time.
  • Right to data portability – You have the right to data portability of your personal data.

Personal Data Options

TCCI recognizes that you have certain rights with regards to your personal data under the Data Privacy Act. TCCI would like to ensure that you consent to continue to collect, use, and disclose your personal data for the purposes identified. Please be informed that you also have the option to object or withdraw your consent or revise your consent preferences.
